Rochester, NY Police officer Cedric Felton Remains Professional, When Asked About Incident With Disabled Man in Wheelchair Being Assaulted by RPD officers, but Female officer Has No Comment

I haven't been to the Lilac Festival in Rochester, NY, since May 16, 2009, when I was hit by a car, while crossing the intersection of South and Highland Avenues.

I was hit by a Toyota Camry, which gives new meaning, to the old Toyota slogan, "Oh what a feeling!", driven by an RIT student who claimed that he never saw me in the crosswalk, even though I waited for the "Walk" sign, and had the right of way.

I never understood how he couldn't see me, as I was wearing a bright red, blue, and white Cuba jersey, but then again, I never saw the car, so I suppose perhaps he really didn't see me.

I also don't understand how two Rochester, NY Police officers who were manning the intersection, found it more interesting to talk with each other, than to cross pedestrians, including myself.

I will never forget how, after I was hit, flew over the car, and landed in the middle of the street, a Rochester Police officer told me "Dude, get away from me, you're bleeding all over the place!", when I was stumbling, dazed, confused, and bloodied, wearing only one sneaker.

After undergoing surgery, and spending a week at Strong Hospital, I didn't walk for almost 6 months.

The best thing after getting out of the hospital was being able to see my beautiful daughter being born, as I sat in a wheelchair, with my leg propped up, looking like the Michelin Man, dressed me in an all white Tyvek suit.

I thank God for surviving getting hit by a car, and seeing my princess come into the world.

So, I decided to take a nice walk through the festival, and I thought I'd see if I could get any Rochester, NY Police officers to comment on the video of a disabled man in a motorized wheelchair, assaulted by Rochester Police officers, which is going viral on the Internet.

As I approached the intersection of Goodman St. and Highland Ave., I noticed two RPD officers, ironically enough, crossing pedestrians.

I couldn't help but to have a flashback of my incident, and how I was almost killed.

"That's better treatment than I got four years ago, when I was hit by a car next to two RPD officers!", I said to the female officer.

She just looked at me.

I thought I'd ask the officers what they thought about a disabled person being beaten by RPD officers.

Officer Cedric Felton, remained professional and courteous, not only commenting, but showing he had no issue with being video recorded, unlike other officers.

After all, if you are doing your job, and doing nothing wrong, then why worry that you're being video recorded?

But some RPD officers don't get it.

The second officer, the female, well, lets just say she wasn't professional, or courteous, like officer Felton was.

Video Shows Rochester, NY Police officer Kneeing Pregnant Young Woman

Although the video is just over a year old, it's still very much relevant when it comes to showing the Rochester, NY Police department's history of abusing citizens, and, very disturbing to watch.

The video starts off with a young, pregnant woman being restrained by three Rochester Police officers in front a Chili Avenue grocery store.

An RPD officer then yells at the young woman's mother "I don't care how old she is!"

While it is not clear what led up to the incident, what is clear is what happens at the 30 second mark of the video.

Shortly after a voice off camera is heard telling the woman's mother "They're not supposed to be doing that to your daughter!", a Rochester Police officer is seen kneeing the young woman in her stomach.

One would think that the last thing Rochester, NY Police officers would be taught in the police academy, would be to assault a pregnant woman, especially by delivering a blow to her womb, where her unborn fetus is growing, REGARDLESS OF THE SITUATION.

Apparently, RPD officers are taught to do whatever they have to do, to restrain an individual, even kneeing a pregnant woman.

After all, what can you expect from a police force, and a Chief, who condones assaulting a disabled man in a motorized wheelchair, like Rochester Police officers did to Benny Warr, as can be seen in the second video below.

Rochester, NY Police officer Allows Woman to Pose Behind the Wheel of RPD Cruiser in a Photo with the Caption "Real Gs steal cop cars n don't give a FUCK!"

In February, I exposed Rochester, NY Police officer Melanie Rivera misusing taxpayer dollars by goofing off inside her police cruiser with her best friend who she takes on ride-alongs.

Rivera seemed more interested in wasting taxpayer dollars by taking photos of her and her friend, the posting them on Instagram, than she is in upholding her oath to "protect and serve.".

Fast forward less than three months later, an interesting photo has popped up on the Internet of a tattooed woman sitting in the driver's seat of a Rochester Police cruiser, with the caption "Real Gs steal police cars n don't give a FUCK!"

In the photo, the woman, Laura Anzalone-Byers, a tattoo artist at Extreme Graphix Tattoo in Rochester, NY, is seen giving the camera the middle finger.

The photo is yet another example of Rochester, NY Police officers misusing taxpayer resources by engaging in inappropriate and unprofessional behavior, in this case the person who sent me the photo, said that the woman's "cop best friend was hanging out wasting tax payer money on the job letting friends pose in his car."

Like I always say, there you have it Rochester, NY, your hard earned, taxpayer dollars at work.

Rochester, NY Police officers Assault Disabled Man in Motorized Wheelchair

Just when I think the Rochester, NY Police
department can't sink any lower, they manage to outdo themselves!

A video posted on YouTube shows a very disturbing incident.

Two Rochester, NY Police officers are seen assaulting Benny Warr, a disabled man in a motorized wheelchair, who was waiting for the bus near the intersection of Jefferson Ave. and Bartlett St. on Wednesday May 1st.

Although the video is shot in an upright position, limiting the shot to 1/3, and is not the best quality, it's clear that Warr did nothing to warrant this use of force.

At one point in the video an RPD officers grab Warr, lifting him off his wheelchair, and throwing him onto the sidewalk.

The woman who recorded the video, Shakur Muhammed, can then be heard saying "Stop, why is you kicking him?", as a third Rochester Police officer arrives on scene.

At another point in the video, an RPD officer is seen pushing Warr's wheelchair out of the way, and then placing his body weight on Warr's arms as he appears to be pushing down on the disabled man.

In another part of the video, Muhammed makes a comment that one of the RPD officers assaulting the disabled man has been harassing neighborhood residents and is mad because he was punched in the face earlier.

This is interesting, as it shows that the RPD officer may be assaulting the disabled man as a way to get his frustrations out over a completely unrelated incident, that has nothing to do with the disabled man.

Towards the end of the 2 minute and 50 second video, RPD officers are seen staring down a group of bystanders which includes Muhammed, the woman recording the video.

An RPD officer is then seen waving his arms, as he tells people "Let's go, let's go, come on, go!", obviously upset that their assault of a disabled man had been recorded on video.

This is typical behavior of the thugs with badges which make up the Rochester, NY Police department.

Warr was taken to the hospital and given an appearance ticket, for disorderly conduct and resisting arrest.

Jefferson Avenue residents say it is not uncommon for Rochester Police officers to assault innocent people.

Ever since Rochester, NY Police Chief James Sheppard announced Operation Cool Down last year, saying that his officers would stop citizens if they don't have a bell on their bikes, I said that all Sheppard was doing, was giving his already rogue, racist officers, a 'free pass' to abuse innocent citizens, just like they did to this disabled man.

Next thing you know, RPD Chief Sheppard will say that Benny Warr's wheelchair didn't have a bell on it.

"With Great Power Comes Great Responsibility"; Is Columbia Pictures, the Producers of The Amazing Spiderman 2, Violating Citizens' Constitutional Rights in Rochester, NY?

It seems that having a major motion picture like "The Amazing Spiderman 2" filming in Rochester, NY comes with a price.

I don't mean in a monetary sense.

I'm talking about Constitutional rights.

When I first heard that Columbia Pictures had chosen to film the chase scene for "The Amazing Spiderman 2", in my hometown of Rochester, NY, I was excited.

In fact, I took my children and my niece to the first day of filming, and we were interviewed by Rochester's NPR Radio affiliate, WXXI, in a segment titled "Caught up in a Web of Excitement."

We each gave several reasons why we felt that having the biggest movie to ever be filmed in New York State, right in our city, was a great thing.

However, as an activist, writer, and filmmaker whose work centers around exposing issues such as police misconduct, abuse of power, and corruption, as well as advocating for people's First Amendment right to photograph and video record, I would have never imagined that one of the costs of having a major Hollywood movie in my city, would mean giving up that right.

Case in point:

Last week, an employee at the law firm of Rochester attorney Robert Brenna, was threatened by a Rochester, NY Police officer with arrest, for doing nothing more than looking out of his office window at filming being done in front of his building.

Also, a cameraman from Rochester's YNN news was told by film crews and Rochester Police that he was not allowed to shoot video, even though he was in a designated public viewing area.

These are just two examples where either Rochester Police officers, or the film's production crew members, have told civilians that they couldn't take photos, record video, or in some cases, simply look at action scenes being filmed, even though they were on public sidewalks, or, looking out of a window.

Last week, I personally witnessed several 20-something-year-old production assistants, or 'P.A.'s' ordering people to "keep it moving", and "move along."

Production assistants also told me to "keep moving" on at least one occasion.

Now let me be clear here, I'm not talking about people who are interfering with filming, I'm talking about people in designated public viewing areas, well behind the any barriers, or cordoned-off areas.

Another thing the film crew P.A.'s have been doing is, once filming is done, and the public, including many downtown workers are allowed to walk through, the P.A.'s have been ordering people not to stop to take photos or record video.

"When movie producers, staff, etc. say 'you have to keep moving', or 'you can't stand still when taking photos', they have no more authority to order people to do, or not do something on a public street than anyone else", said Mickey Osterreicher, General Counsel for the National Press Photographers Association, adding, "If the production company has a permit to film and has set up a perimeter for that scene, you may be barred from entering, but once they open it to the public or if you are outside that area, then you have a right to photograph and record, and may not be told otherwise."

Some of the film's production assistants have been using "security and copyrights" as an excuse when they tell people that they have to move along and can't take photos or videos.

"You can't tell the public, or the press that they're allowed in a public place, but they have to leave their First Amendment rights at the door," said the NPPA's Osterreicher.

"It is one thing if someone is somehow interfering with their production, but outside that area, if the public is allowed to be there, then everyone, including the press, is allowed to be there, and they can't say that someone can't do something because it is inconveniencing them, or because their bosses told them to order people around", Osterreicher said.

"Once you tell them they have no authority to order you about in this way, they usually call the police or their security, who are often off-duty officers. Private security on a public street do not have any greater authority than the twenty-somethings. Should the police order someone to stop taking photos in a public place, or to keep moving when they are in public and they have a purpose for being there, then they are now violating your First Amendment rights because they are ostensibly acting under color of law". said Osterreicher, from Orlando, Florida, where he is
teaching a class to the International Association of Chiefs of Police, on the First Amendment right to photograph and video record police in public.

So, beneath all the excitement of Hollywood invading Rochester, NY for a week and a half to film one of he biggest superhero movies of all time, a very disturbing thing is happening.

Young film production crew members seem intent on violating the United States Constitution, while seeming to only be concerned about completing their shoot, and Rochester, NY Police officers seem intent on continuing to do what they have a long history of doing so well, abusing their power.

Given the fact that a Rochester, NY Police officer threatened a law firm employee with arrest for looking out of a window, it begs the question:

Is Columbia Pictures, using the Rochester, NY Police department to assist them in violating people's Constitutional Rights?

I wouldn't doubt it.

It's not uncommon for film crews to have police officers do their 'dirty work' for them.

In June of 2011, Carlos Miller who founded the popular site Photography is Not a Crime, or "PINAC", exposed Fort Lauderdale, Florida Police officers whom Miller described as "hired guns for the Rock of Ages film set."

In that case, Ft. Lauderdale Police officers harassed, intimidated, and threatened photojournalists who tried to photograph actors in public.

The filmmakers in Ft. Lauderdale posted signs telling people that they were forbidden from taking photos, and referencing a city ordinance that had nothing to do with photography or trespassing for that matter.

Fort Lauderdale cops even went as far as to put up a sign which read “photography of this area is prohibited” and that violators would be arrested.

A photographer was issued a citation, which apparently was for trespassing, for taking pictures from a public garage.

Shortly after the story ran in Photography is Not a Crime, the signs went down, and as Miller wrote in an updated piece: "Photography is no longer a crime in Fort Lauderdale. Not that it ever was."

So,when it comes to law enforcement abusing their power by barking unconstitutional orders at citizens, perhaps the NPPA's Osterreicher sums it up best:

"Because I said so', is fine for your mother to say, but police cannot order you to do, or not do something unless they have a legal basis to do so. You have a First Amendment right to photograph and record in a public place unless you are doing something else that is in violation of the law. So, often police will threaten to arrest you, or actually just do it, for being disorderly or for obstruction of governmental administration, or for loitering or trespassing, but as the US Department of Justice has recently stated in another case, these are highly discretionary charges that should be viewed as highly suspect by the court when used against someone doing nothing more than taking pictures or recording video on a public street.

It seems like somewhere along the line, "The Amazing Spiderman 2" film producers forgot the classic line, "With great power comes great responsibility."

Or maybe the just never cared.

Rochester, NY Police officer Violates Code of Ethics, and his Sworn Oath to Serve and Protect

There is a section of the Rochester, NY Police department's Code of Ethics which reads: "I WILL never act officiously or permit personal feelings, prejudices, animosities or friendships to influence my decisions."

On Monday, April 29th, I promised my two sons, ages 9 and 11, and my niece, 12, to take them to the first day of filming for The Amazing Spider-Man 2, on the first day of filming in downtown Rochester.

We woke up at 4 a.m., showered, and grabbed breakfast, making it to downtown by 5:30 am, in anticipation of big crowds, a Spider-Man would surely attract.

As we walked down West Main Street, after parking at the Sister Cities garage, near City Hall, I wanted to make sure we got a good spot from which to watch from, away from traffic, and the stunt scenes which would be filmed, as my main concern was my children's safety.

About halfway down the block, we found a spot we liked, and stopped.

At that point, a man told me to ask and make sure it was ok to stand there.

Seeing no one else around, except a Rochester, NY Police officer who was about 100 feet away, I decided to ask the officer where it was ok to watch from.

"Good morning", I said as I approached the officer who was standing near his W-46 cruiser.

The officer took one look at me, and asked me "What's your name?", as he looked at my press pass for Minority Reporter Media Group, the publisher for two local publications I write for, and then said "I'm not talking to you!", and walked away.

It was here where, I turned on my iPad, which I had been holding, and proceeded to ask the officer, whom I have never met, or seen before in my life, for his name, which as you can see in the video below, he refused to give me.

Clearly, this Rochester, NY Police officer doesn't like me.

He doesn't have to like me.

However, to allow his personal feelings, prejudices, or animosities that he has towards me as a result of my work exposing police misconduct, and corruption on the part of the Rochester, NY Police department, is not only a clear violation of the RPD's Code of Ethics, but a violation of his sworn oath to serve and protect.

This Rochester, NY Police officer's outright refusal to help me find a safe location for my children and myself to stand, is more than deplorable, frankly it's disgusting.

For this officer to potentially put young children's safety at risk by refusing to assist us, all because of an obvious animosity he has towards me, is something that the Rochester, NY Police department, especially Chief James Sheppard, should NOT condone.

After all, on the Rochester, NY Police department's new website, it states: "Embracing a philosophy of Policing in the Spirit of Service represents the Rochester Police Department’s commitment to consistently provide excellent police services to all of the Rochester community. This commitment requires every employee to strive for excellence, while demonstrating courtesy, professionalism and ethics. It is important to acknowledge that every interaction with the community has an impact not only on each individual employee’s reputation, but on the reputation of the entire Rochester Police Department as well."

Yep Chief Sheppard,

By your officer allowing his personal feelings to get in the way of him doing his job, it certainly does have an impact on your entire department.

Chief Sheppard, officers like this are the reason the community does not trust, or respect your department.

To make matters worse, watch as I try to talk to another RPD officer, who, as soon as I tell him my name, also refuses to talk to me, and immediately turns around.

Rochester, NY Taxpayer Dollars at Work: RPD Truancy officer Frank Coriddi Caught on Duty, Playing Hookie!

had no comment, after he was caught playing hookie.

You just never know where you will find an on duty Rochester, NY Police officer, misusing taxpayer dollars.

But a hardware store which sells and services lawn and garden equipment, would not have been on my top 10 list.

Well, it should have been.

You see, that's exactly where I happened to see Rochester, NY Police officer Frank Coriddi Monday morning around 9:00 am.

Coriddi, who works with the RPD's truancy division, pulled the RPD's YS-2 Chevy van into Wilson's hardware located at 812 Monroe Avenue, and got out carrying lawn and garden equipment, including what looked to be a long orange chainsaw.

I thought it would be interesting to ask officer Coriddi exactly what he was doing at the hardware store, bringing in lawn and garden equipment, on duty.

Although the video below didn't catch the first 20 seconds, here's how that part of the conversation went:

Me: Good morning officer, can I ask you a question?

Coriddi: (hesitant) sure.

Me: Did you just bringing in lawn and garden equipment here?

Coriddi: Yes.

Me: Personal equipment, on duty?

Coriddi: Yes, but I can't talk to you Davy.

Coriddi then starts to walk away which is where the video starts.

It's interesting that Rochester, NY Police officer Frank Coriddi's job, is basically catching kids that play hookie by not going to school.

Seems to me, officer Coriddi likes to play hookie too.

Only difference is, he does it on Rochester taxpayer dollars.
